F. Responsibilities of Direct Selling Member Entity or Direct seller for a member Entity towards ADSEI

The ADSEI ‘s Executive chairman, upon finding a member
entity has engaged in false, misleading or deceptive recruiting practices, may employ any appropriate remedy to ensure any complainant shall not incur significant financial loss as a result of such prohibited behavior, including but not limited to requiring such member entity to repurchase any and all Goods/inventory, promotional materials, sales aids and/or kits which a complainant has purchased and refund the amount or service fees .
- That Member entities will be considered responsible for Code violations by their Direct sellers where the ADSEI’s Executive chairman finds, after considering all the facts, that a violation of the Code has occurred. For the purposes of this Code, in the interest of fostering consumer protection, member entities shall voluntarily not raise the independent contractor status of Direct sellers distributing their products or services under its trademark or trade name as a defense against Code violation
allegations, provided, however, that such action shall not be construed to be a waiver of the member entities’ right to raise such defense under any other circumstance.
- That this Code is not law but its obligations require a level of ethical behavior from member entities and Direct sellers that is consistent with applicable legal requirements. Failure to comply with this Code does not create any civil law responsibility or liability.
- That Whenever, a entity leaves the ADSEI membership, a entity is no longer bound by this Code. However, the provisions of this Code remain applicable to events or transactions that occurred during the time a entity was a member of ADSEI .
- That All member entities are required to publicize the ADSEI Code of Ethics and the process for filing a Code complaint to their independent Direct sellers and consumers. For this purpose the ADSEI shall provide the link at the website of the ADSEI.
- That Each member entity and pending member entity is required to designate a ADSEI Nodal Officer. The Nodal Officer is responsible for facilitating compliance with the
Code by his or her entity and responding to inquiries by the ADSEI’s Executive chairman. He or she will also serve as the primary contact at the member entity for communicating the principles of the ADSEI Code of Ethics to the member entity’s independent Direct sellers, employees, consumers and the general public.
Further such Nodal Officer shall be in touch with the ADSEI for all compliances such as included but not limited submission of yearly and quarterly audit and assessment papers, quarterly returns, deposition of timely of Membership fees etc. That member entity will Serve their association with loyalty and respect for confidentiality, avoiding conflicts of interest and activities for personal advantage to the detriment of their association or their members.
- That member entity will Bring to the attention of their associations’ governing boards potential decisions or actions that they identify as unethical or illegal, and inform their boards of the possible results of such decisions or actions.
- That member entity will Serve all members of their
associations with impartiality, providing no particular benefits to any member, and accepting no personal compensation from a member without the prior knowledge and approval of their association’s governing board.
- That member entity will Ensure, to the best of their ability, that interactions between employees, suppliers, clients and volunteers are fair, free of unwarranted discrimination and harassment.
- That member entity will Engage in professional development to further their competence as association executive
- That member entity will Support the ADSEI’s work to
advance professional standards.
- That member entity will Be respectful to the ADSEI if it disagrees with its advice or policies, giving it the opportunity to comment, reply or change its processes, in a professional manner
- Members of ADSEI worldwide are committed to ethical professional conduct and operate in good faith to their motto “My Word is My Bond”.
- That the Direct selling Members entity shall have
Maintain high standards of professional competence, conduct, and ethical practice- at all places such as at office, in working , with employees and Direct sellers, with other Direct selling entity members, in technical knowledge and with awareness of the social context, in communication, in reflective analysis, and in recognizing and navigating ethical challenges, attending conferences or seminars, and other informal or formal education. Professional organizations and employers should encourage and facilitate these activities. While attending these conferences and seminars, ADSEI Members should act professionally and be respectful of their colleagues, ADSEI staff and the host organization.
